What information must the Police give me before the search?
Before
any search of a person or vehicle takes place, the Police must take steps to provide the detained person with the following
information:
- that
they are being detained for the purpose of a search
- the
officers name and the station which they are attached to. If it is a plain clothes officer, a warrant (identity) card must
be shown to you.
- why
they have stopped you and what they are looking for
- before
the search begins, the officer must inform you that you are entitle to a copy of the record of the search. If it is impracticable
to provide a copy of a record of the search at the time, then you should be informed of your entitlement of a copy within
12 months.
